Legal Limits - DUI

You can be charged with OVI/DUI for having illegal levels of alcohol and/or drugs in your system.  The most typical testing methods are via Breath and Blood.  Below are the current legal limits outlined by substance and testing method.  The legal limits for underage DUI are also listed.

Alcohol Level:

Breath and Whole Blood- .08-.169 (low test); .17 and higher (high test)

Blood Serum/Plasma- .096-.203 (low test); .204 and higher (high test)

Urine- .11-.237 (low test); .238 and higher (high test)

Amphetamine:

Urine- 500ng or more

Whole Blood, Blood Serum & Plasma- 100ng or more

Cocaine:

Urine- 150ng or more

Whole Blood, Blood Serum & Plasma- 50ng or more

Heroin:

Urine- 2000ng or more

Whole Blood, Blood Serum & Plasma- 50ng or more

Marihuana:

Urine- 10ng or more

Whole Blood, Blood Serum & Plasma- 2ng or more

Methamphetamine:

Urine- 500ng or more

Whole Blood, Blood Serum & Plasma- 100ng or more
