FELONY PENALTIES - PRISON TERMS - FINES - DEFENSE ATTORNEY

A felony is a serious charge with serious penalties and long term impact on your future ability to obtain employment.  This page outlines felony penalties.

Aggravated Murder

Prison Term:  Depends upon whether the conviction is with or without a Death Specification.  With Death Specification, the prison term is either the death penalty, life in prison without parole, or life with parole after 20, 25, or 30 years.  Without Death Specification, the prison term is life with parole eligibility after 20 years or life without parole (if the conviction has a sexual motivation and/or sexual predator specification).

Fine: Up to $25,000.00

Murder

Prison Term: 15 years to life.  Life without parole if the conviction has a sexual motivation and/or sexual predator specification.

Fine: Up to $15,000.00

First Degree Felony

Prison Term: 3, 4, 5, 6, 7, 8, 9, or 10 years.

Fine: Up to $20,000.00

Second Degree Felony

Prison Term: 2, 3, 4, 5, 6, 7, or 8 years.

Fine: Up to $15,000.00

Third Degree Felony

Prison Term: 1, 2, 3, 4, or 5 years.

Fine: Up to $10,000.00

Fourth Degree Felony

Prison Term: 6, 7, 8, 9, 10, 11, 12, 13, 14, 15, 16, 17, or 18 months.

Fine: Up to $5,000.00

Fifth Degree Felony

Prison Term: 6, 7, 8, 9, 10, 11, or 12 months.

Fine: Up to $2,500.00

Specifications

There are numerous specifications that can add additional time to the above stated prison terms.  These include, but are not limited to:

  • Possession or Use of a Firearm;
  • Repeat Violent Offenders;
  • Major Drug Offenses; and
  • Corrupt Activity.
