MISDEMEANOR PENALTIES - JAIL - FINE

On this page you will find a brief discussion of the different degrees of and penalties for misdemeanors. Many simple traffic violations (speeding, etc.) have been reclassified as fourth degree misdemeanor offenses- subjecting you to a possible jail sentence!  For an explanation of Ohio’s point system for speeding tickets and other traffic violations click HERE.

Ohio misdemeanor crimes are classified into one of 6 degrees or categories:

Minor Misdemeanor:

There is NO jail associated with a Minor Misdemeanor. Maximum fine is $150.00.

4th Degree Misdemeanor:

Conviction of a Fourth Degree Misdemeanor can result in a jail sentence of up to 30 days and fines up to $250.00.

3rd Degree Misdemeanor:

Conviction of a Third Degree Misdemeanor can result in a jail sentence of up to 60 days and fines up to $500.00.

2nd Degree Misdemeanor:

Conviction of a Second Degree Misdemeanor can result in a jail sentence of up to 90 days and fines up to $750.00.

1st Degree Misdemeanor:

Conviction of a First Degree Misdemeanor can result in a jail sentence of up to 180 days (six months) and fines up to $1,000.00.

Unclassified Misdemeanor:
